An expert report was prepared in the Alya Uçar Apartment case: 2 more people outside the case are responsible

During the February 6 earthquakes centered in Kahramanmaraş, 14 people, including 2 babies and 1 child, lost their lives in the Alya Uçar Apartment Building in Ekinci District of Antakya district of Hatay.

Hatay Chief Public Prosecutor's Office filed a lawsuit against contractor Hikmet Günsay, construction site manager Adem Sabırlı, static project designer Ayhan Girişken, application inspector Ali Şahin, project and application inspector Antuvan Ayrancıoğlu and ground survey project designer Salih Zorsu for "causing death and injury by negligence".

There is no detained defendant in the file.

At the third hearing held on January 29 at the Hatay 3rd High Criminal Court, it was decided to obtain an expert report again.

7 months later, the expert report prepared by 7 academics from Pamukkale University was submitted to the file.

2 PERSONS OUTSIDE THE CASE WERE DETERMINED TO BE RESPONSIBLE

In the expert report, it was stated that the contractor Hikmet Günsay was responsible for the use of concrete that did not comply with the standards and for providing an incomplete or faulty static/reinforced concrete project, and the site manager Adem Sabırlı was responsible for the use of concrete that did not comply with the standards and the longitudinal reinforcement spacing in the columns was contrary to TS-500.

In the report, it was stated that the static project designer Ayhan Girişken was responsible for preparing the project that did not take into account some critical issues in the Regulation on Buildings to be Built in Earthquake Zones (2007), and Mustafa Akıncı, the official of the out-of-case building inspection organization, was responsible for not detecting and reporting the deficiencies in the project and the use of concrete that did not comply with the standards.

In the expert report, it was noted that project and application auditor Antuvan Ayrancıoğlu and application auditors Ali Şahin and Raşit Akyurt, who were not in the case, were responsible for not detecting and reporting the deficiencies in the static/reinforced concrete project, the use of concrete that did not comply with the standards, and the non-compliance of the reinforcement spacing in the columns with TS-500.

A "PROVINCIAL LINK" COULD NOT BE ESTABLISHED IN TERMS OF MUNICIPALITY AND GROUND SURVEY

In the report, it was stated that, according to the municipality's building control unit responsible, although the high roof cover was built against the license and zoning plan, there was no evidence that this production affected the load-bearing system and therefore no causal link could be established.

It was determined that the soil survey project designer, Salih Zorsu, was not the author, and the main author was Ahmet Güney, who was out of the case. It was reported that the ground survey report dated June 2011 was evaluated to be in compliance with the regulations and circulars, and no causal link could be established in terms of the soil survey project designer.

THE SIXTH HEARING WILL BE HELD ON 24 SEPTEMBER

Those who lost their relatives in the earthquake demand the Hatay Chief Public Prosecutor's Office to prepare an urgent indictment against the 2 people who were found to be responsible for the collapse of the building, and to arrest the at-fault defendants.
